2. Purpose of the application

The FAME Live application is a digital assistant dedicated to creators of LIVE content on TikTok. It aims to educate creators to optimize their strategy, help them find opponents for LIVE matches to improve their monetization, better organize their schedule to optimize their visibility, and define growth objectives to increase their success.

Target users include TikTok LIVE content creators, whether individuals or agencies.

3. Conditions of access and use

3.1 Eligibility requirements

The application is available to users of legal age (the minimum age for LIVE on TikTok is 18).

3.2 Device compatibility

The FAME Live application is compatible with mobile devices only.

4. Types of services offered

FAME Live offers three types of services:

Free version: Limited access to basic functions.
Paid version: Monthly or annual subscription to access advanced features.
Agency version: Content creators can benefit from a subscription paid for by their agencies.

Users can choose a monthly or annual subscription, depending on their needs.

5. Rules of use

FAME Live users must comply with the following rules:

No spamming or harassment of other users.
Respect other users and avoid offensive or illegal content.
Refrain from fraud, hacking, or any misuse of the application.
Do not share educational content provided by the application without authorization.
Avoid excessive use of the match search feature, which could lead to repeated cancellations.

6. Protection and intellectual property rights

The FAME Live application and all its contents (software, source code, interface, design, database, functionalities, texts, images, videos, etc.) are protected by intellectual property law. The application is registered with the Agence de Protection des Programmes (APP) under registration number IDDN.FR.001.260005.000.S.P.2024.000.00000. Any reproduction, modification, distribution or use without express authorization is strictly prohibited and may result in legal action.

7. Reverse Engineering Prohibition Clause

The User agrees not to attempt to decompile, disassemble, modify, adapt, reproduce, distribute or exploit in any way all or part of the FAME Live software. Any attempt to reverse engineer, extract code or analyze the internal workings of the application is strictly prohibited. Any violation of this prohibition will result in the immediate termination of the User's account, without prejudice to any legal action that FAME App may take to enforce its rights.

8. Reproduction and Derivation Prohibition Clause

The User acknowledges that the FAME Live application, including but not limited to its source code, algorithms, user interfaces and functionality, is the exclusive property of FAME App. The User is strictly prohibited from copying, reproducing, modifying, deriving or adapting any functionality, interface, logic or technology from the application for personal or commercial use, directly or indirectly. Any attempt to exploit or imitate the application, whether in whole or in part, may give rise to legal proceedings.

9. No Fraudulent Use of Accounts Clause

Registration and use of the FAME Live application are strictly personal and nominative. Users must register under their true identity and provide accurate information when creating their account.

It is strictly forbidden to:

Creating an account under a false identity or using false information.
Use or access another user's account, even with their consent.
Share, sell, lend or transfer your account to another person.
To have more than one active account for the same person, unless expressly authorized by FAME App.

Any breach of this clause may result in the suspension or permanent deletion of the account, without prior notice, as well as legal proceedings in the event of proven abuse.

10. Protection of personal data

FAME App collects the following data:

Personal information: first name, email, country, language, gender, TikTok name.
Usage data: number of matches found, interactions with application functions.

TikTok email addresses and names can be shared with partner agencies, if the user gives explicit consent via the application. This applies in particular to creators who are not currently affiliated with an agency but wish to join a FAME Live partner agency.

This data is used for :

Provide and improve application services.
Customize the user experience according to language and country.
Send promotional communications (only with the prior consent of the user).

11. Limitation of liability

FAME App cannot be held responsible for :

Technical problems.
Data loss.
Service interruption.

The user is responsible for the use he makes of the application and undertakes to respect the present conditions of use.

12. Termination

Users can cancel their account or subscription at any time via the download platform (App Store or Google Play Store).

In the event of a breach of these terms of use, FAME App reserves the right to suspend or terminate the user's account without notice.

13. Changes to the terms and conditions

FAME App reserves the right to modify these terms of use at any time. Users will be informed of changes by notification or email. Continued use of the application after such modifications constitutes acceptance of the new conditions.

14. Jurisdiction and applicable law

These terms of use are governed by French law. In the event of a dispute, the parties will endeavor to find an amicable solution. If no solution is found, the dispute will be submitted to the exclusive jurisdiction of the Marseille courts.

15. Additional terms for iOS users

For iOS users, this application is also governed by Apple's standard End User License Agreement (EULA). In the event of any conflict between these Terms of Use and Apple's EULA, the latter shall prevail for iOS users.
