FAME Live Privacy Policy

This Privacy Policy describes how FAME App collects, uses and safeguards information about users of the FAME Live application.

We respect the confidentiality of your data and are committed to protecting it in accordance with current regulations, including the General Data Protection Regulation (GDPR) as well as Apple App Store and Google Play Store requirements.

 

1. Glossary

 

In the Privacy Policy, unless otherwise specified, the following words and expressions have the respective meanings indicated below:

Application: refers to the FAME Live application

CNIL: Commission Nationale de l'Informatique et des Libertés.

Personal Data: refers to any information relating to an identified or identifiable natural person.

Service provider: refers to all service providers with whom FAME Live has a contractual relationship.

Regulation: refers to Law no. 78-17 of January 6, 1978 relating to information technology, files and freedoms as amended, Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter "RGPD") as well as any regulations in force concerning the protection of Personal Data.

Data controller: means the natural or legal person, public authority, department or other body which, alone or jointly with others, determines the purposes and means of processing.

Subcontractor: refers to the natural or legal person, public authority, department or other body that processes Personal Data on behalf of the Data Controller.

Terminal: refers to the hardware equipment (telephone) that you use to consult or view the Site.

Processing or Treatment of personal data: means the collection, recording, organization, structuring, storage, adaptation or modification, retrieval, consultation, use or otherwise making available, alignment or combination, restriction, erasure or destruction.

User: refers to the person browsing the Application.

 

These definitions are capitalized and apply to both the singular and plural.

 

2. What is the scope of the Privacy Policy?

 

This Privacy Policy is intended for Users.

 

Consequently, access to the Application implies that you have read and accepted all the terms of the Privacy Policy, and therefore the collection and use of your Personal Data.

 

3. Who is involved in protecting personal data?

 

The controller of Personal Data is FAME Live, a simplified joint stock company, registered in the Marseille Trade and Companies Register under no. 932 507 841, whose registered office is located at 96, rue Paradis 13006 Marseille, for the Processing that it implements on the Personal Data collected from Users.

4. What is the nature of the Personal Data processed by FAME Live?

 

FAME Live takes into account the principles of data minimization, data protection by design and data protection by default. Consequently, information is collected that is relevant, adequate and limited to what is necessary for the purposes for which it is processed, and in particular for the operation of the Application.

 

This Personal Data is collected when you register for the Application or when you contact FAME Live.

 

When you choose to spontaneously send your Personal Data to FAME Live, without being asked to do so, you expressly consent to the collection of Personal Data and you agree to assume full responsibility for the Personal Data transmitted. 

 

FAME Live processes the following Personal Data:

·       Email (in case of manual registration with email address)

·       TikTok username

·       Language and country

 

5. What are the Processing purposes and legal bases?

 

FAME Live collects and processes Personal Data only if one of the following conditions is met:

 

-        FAME Live has obtained your prior consent;

-        Processing is necessary to comply with FAME Live's legal or regulatory obligations; or

-        The Processing is necessary for the purposes of the legitimate interests pursued by FAME Live and does not unduly affect your interests or fundamental rights and freedoms.

 

5.1 On the basis of FAME Live's legitimate interest :

 

On the basis of legitimate interest, FAME Live carries out the following Processing operations:

·       Optimization of services offered by the Application ;

·       Personalizing the user experience by country and language.

·       Analysis of Application performance in order to improve our services;

·       Performance monitoring by the User's agency.

 

5.2 On the basis of Users' consent :

 

On the basis of Users' consent, FAME Live carries out the following Processing operations:

-        Sending promotional communications if the User consents.

 

In this context, you may withdraw your consent at any time, without this withdrawal affecting the lawfulness of the Processing carried out by FAME Live prior to the said withdrawal.

 

5.3 On the basis of compliance with legal and regulatory obligations

 

FAME Live may also use your Personal Data to meet its legal and regulatory requirements, in particular concerning:

-        Responding to security, anti-fraud or law enforcement requirements.

 

6. How long is Personal Data kept?

 

FAME Live retains your Personal Data for as long as is necessary for the fulfillment of the purposes for which it is to be used, subject to the legal possibilities of archiving, obligations to retain certain Personal Data and/or anonymization.

 

The Personal Data of Users of the Application are kept for a period of three (3) years from the last contact, subject to legal possibilities for archiving, obligations to keep certain Personal Data and/or anonymization.

 

7.  Who receives your Personal Data?

 

FAME Live never passes on your Personal Data to third parties who may use them for their own purposes, in particular for commercial purposes and/or direct advertising.

 

FAME Live may share your Personal Data, only to the extent necessary, with :

 

-        Its subcontractors, for the performance of tasks relating to the purposes described above (FAME Live's data host)

-        Its partner agencies, so that they can follow their creators ;

-        Public authorities: FAME Live may be obliged to communicate your Personal Data in response to a specific request made by a competent administrative or judicial authority, as well as more generally in all situations where the law, regulation or an administrative or judicial decision requires it.

 

8. How is your Personal Data stored?

 

Personal Data is stored on AWS servers located in Europe (Paris, eu-west-3 region).

 

The email addresses collected are stored by OneSignal to enable an OTP verification code to be sent upon registration or if the password is forgotten.

 

9. How is the security of Personal Data ensured?

 

FAME Live undertakes, within the framework of its activities and in accordance with the Regulations, to ensure the protection, confidentiality and security of Personal Data.

 

FAME Live takes the necessary precautions, taking into account the state of the art, the costs of implementation and the nature, scope, context and purposes of the Processing as well as the probability of each risk, in order to preserve the security and confidentiality of the Personal Data that you communicate to it and in particular to prevent it from being deformed, damaged or communicated to third parties (except with your consent).

 

Consequently, FAME Live implements all technical, logical, physical and organizational measures to guarantee a level of security appropriate to the risk and to prevent any loss, alteration, disclosure of Personal Data or access by unauthorized third parties.

 

However, given the intrinsic characteristics of the Internet, any transmission of information via the Internet is not totally secure. Personal Data transmitted to FAME Live is subject to measures that cannot protect against all risks of misappropriation and/or piracy. The transmission of your Personal Data is therefore at your own risk.

 

In the event of a violation of Personal Data and in accordance with the Regulations, FAME Live undertakes to notify the CNIL.

 

10. Does FAME Live use cookies?

 

Cookies are small computer files stored on your Terminal's hard drive which record certain information in order to facilitate your browsing experience. They are deposited on your Terminal when you browse the Site.

 

FAME Live uses the following Cookies:

 

-        Firebase Analytics: these analysis cookies provided by Google enable us to better understand User behavior.

 

 Firebase Analytics collects aggregated and anonymized data, including:

-                Application usage statistics (time spent, most frequently used features)

-                Device and operating system information

-                Track interactions with the application (clicks, navigation)

 

Analytical data are used as follows:

-                Improved application functionality and performance

-                Optimizing user experience

-                Identification and resolution of technical problems

 

Anonymized data collected by Firebase Analytics may be stored on Google servers, including outside the European Union, to generate analyses.

FAME Live does not currently use cookies or third-party tracking technologies outside Firebase Analytics.

However, FAME Live may integrate third-party cookies or SDKs in the future to improve performance and user experience. Users will be informed prior to any such implementation and will have the opportunity to accept or decline such collection.

 

11. How can you manage/delete cookies?

 

Accepting this system does not expose you to any risk. Cookies do not damage your terminal.

Cookies are collected by Firebase Analytics only if you give your consent. Users may disable analytics tracking at any time.

 

12. Does FAME Live transfer Personal Data outside the European Union?

 

Your Personal Data may be transferred to a FAME Live Subcontractor located outside the European Union.

In the event of transfers, these are systematically based on an adequacy decision by the European Commission concerning the countries ensuring an adequate level of protection.

 

13. What are your rights?

 

FAME Live informs you that you benefit, under the terms and conditions provided for in the Regulations :

 

-        A right to information: You have the right to receive clear, transparent and easily understandable information about how we use your information and your rights.

 

-        A right of access: you have access to the Personal Data concerning you that FAME Live holds and processes.

 

-        A right of rectification: you have the right to ask FAME Live to rectify information concerning you in the event of errors or inaccuracies.

 

-        A right to object: where Processing is based on FAME Live's legitimate interests, you have the right to object, on legitimate grounds, to Processing of Personal Data. Please note that this right to object does not apply if our legitimate interests in continuing the Processing prevail over yours.

 

-        A right to limitation of processing: you have the right to FAME Live not to keep some of your Personal Data for future processing when:

o   You dispute the accuracy of your Personal Data;

o   You consider and can establish that the Processing of Personal Data is unlawful and you object to the erasure of the Personal Data and demand instead the limitation of the Processing;

o   FAME Live no longer requires your Personal Data but it is still necessary for the establishment, exercise or defence of legal claims;

o   You object to the Processing being based on the legitimate interests of FAME Live, while the verification is being carried out as to whether the legitimate interests pursued by FAME Live prevail over those of the data subject.

 

-        A right to erasure: subject to the exceptions provided for in the Regulations, you have the right to obtain from FAME Live the erasure of your Personal Data, where one of the following grounds applies:

o   Your Personal Data are no longer necessary for the purposes for which they were collected or otherwise processed;

o   You wish to withdraw your consent on which the Processing of your Personal Data was based and there is no other basis justifying such Processing;

o   You object to the Processing and there are no compelling legitimate grounds for the Processing or you object to the sending of commercial solicitations;

o   You consider and can establish that your Personal Data has been processed unlawfully;

o   Your Personal Data must be deleted by virtue of a legal obligation.

 

-        A right to the portability of your data : when the Processing is based on your consent or a contract, you have the right to receive from FAME Live the Personal Data concerning you in a structured, commonly used format, and to transmit this Personal Data to another controller without FAME Live hindering it.

 

Where technically possible, you may request that your Personal Data be transferred directly from FAME Live to another Data Controller.

 

-        A right to withdraw consent: when Processing is based on your consent, you have the right to withdraw your consent at any time, without FAME Live being able to object.

 

-        A right to decide what happens to your Personal Data after your death: Finally, you have the right to organize what happens to your Personal Data after your death by adopting general or specific directives. FAME Live undertakes to respect these directives. In the absence of directives, FAME Live recognizes the possibility for heirs to exercise certain rights, in particular the right of access, if it is necessary for the settlement of the deceased's estate; and the right of opposition to proceed with the closure of the deceased's user accounts and to oppose the Processing of their data.

If, despite FAME Live's efforts to preserve the confidentiality of your Personal Data, you believe that you have been the victim of a breach of the Regulations, you may submit a complaint to the national data protection authority: Commission Nationale de l'Informatique et des Libertés (CNIL), 3, place de Fontenoy - TSA 80715 -75334 Paris CEDEX 07 (+33 1 53 73 22 22 - www.cnil.fr). You also have the right to seek redress from the competent courts if you consider that we have not respected your rights.

 

14. How can I be notified of changes to our privacy policy?

 

FAME Live reserves the right to modify its Privacy Policy. In the event of a major change, Users will be informed via a notification in the Application.
